"Shooting Occurs Following Allegation of Rape"
 

Los Angeles: On Thursday, November 14, 2002, at approximately 9:00 p.m., the victim, a 17 year-old female accepted a ride from an acquaintance, 25 year-old Jose Argueta. According to the victim, Argueta drove to Sepulveda Recreational Park, in the Devonshire Area, where he sexually assaulted her. Argueta then drove the victim home and dropped her off.
The victim told her brother and her boyfriend that she had been sexually assaulted. The victim’s father, 39 year-old Martin Hernandez, learned about the incident and received information that Argueta was at Pacifica Hospital, located in the Foothill Area, picking up his girlfriend. The victim’s father went to the hospital and shot Argueta. Argueta sustained three minor gunshot wounds to the torso. The father was taken into custody without incident at the hospital and booked for attempt murder.
Argueta has also been booked for raped.
